The aim of this presentation is to explain the new role of free and open source software and open tech in the EU’s digital strategy. To explain why this is worth discussing, I will start by making the case for why I believe that the EU now, since 2022, has a credible strategy for the ambitious task of catching up with the US and China on AI and cloud.

We will then look at the new role of open tech and how it is now treated by the EU regulation. We will look at how the FOSS ecosystem is making use of these new opportunities and what is missing for us to be more effective. This context is an important part of understanding how legislation such as the CRA and the AI Act will be applied.
